Case Studies
Do Not Open the Electrical Panel Door
January 29, 2024
While erecting a scaffold at a power plant, a scaffolder made a tragic mistake when he opened the electrical panel door protecting energized high-voltage equipment. We identified the applicable electrical generation regulations, industry standards, responsibilities of independent contractors, and individual human factors to determine the incident’s cause and responsibilities. Our expert report of opinions was used to negotiate a settlement.
Power Plant Project – did incomplete control narratives result in out-of-control project schedule
July 28, 2023
A disagreement between an EPC contractor and its subcontractor led to a dispute about the causes and impacts of delays and cost escalation for constructing a combined cycle power plant. We reviewed the project documents, records, and correspondence and compared the significance of the delays in the control narrative deliverables to the overall project delays and schedule milestones. We produced a technical expert report, followed by a joint expert report, and provided oral testimony at the arbitration hearing.
Power Plant Construction Dispute Energized by Missed Milestones
October 12, 2022
After key project schedule milestones were missed for a combined cycle power plant mega project, the Contractor and its Subcontractor began faulting one another for the delays and cost escalation. Baker & O’Brien analyzed the project documents, contemporaneous records, and correspondence to determine the responsibilities and impacts for the missed milestones. Our expert opinions, rendered in a technical report, a reply expert report and various joint expert reports proved useful in resolution of the dispute.
